Data protection pursuant to General Data Protection Regulation (GDPR/DSGVO) and § 13 Telemediengesetz (TMG)

1. Scope

This data protection regulation applies to internet services offered by pedocs (pedagogical documents), accessible via www.pedocs.de, and to personal data accessed via this website. For internet sites that are offered by other providers and linked to this site, please refer to the respective data protection regulations for the external sites.

2. Operator of the internet service

This website is operated by DIPF | Leibniz Institute for Research and Information in Education. DIPF holds responsible for processing the personal data that are assessed via this website. You will find the address and contact data in the imprint.

3. Responsible data protection officers

4. Lawful basis for data processing and handling of your data

DIPF will use the data assessed via this website to deliver the services offered, and users will thus be able to avail themselves of these services.

Legally, the partly temporary storage of data and log files is based on points a and f, article 6(1), GDPR. Personal data which we acquire for the purpose of delivering particular services are only assessed after you have given your consent to the assessment, storage and processing of these data according to the terms of use and pursuant to point a, article 6 (1), GDPR.

Personal data assessed by this website will not be transmitted to any third party if you have not given your consent to such a measure. Services offered by ‘Fachinformationsdienst’ are delivered by several institutions (co-operation partners), depending on the discipline concerned. To deliver the desired services, it is occasionally necessary to transfer the relevant personal data to co-operation partners. Legally, these partners do not act as external parties.

5. Type of assessed data

a) Usage of data

Upon each request of an internet file, the following access data are stored at DIPF, which are not related to individual persons:

  • the site from which the file was requested,
  • the name of the requested file,
  • the date and time of request,
  • the transferred volume of data,
  • the status of access (file transferred, file not found etc.),
  • the type of access (GET, POST),
  • the browser resp. operating system used,
  • the session ID

6. Duration of storage

For delivery of services offered on this website, some personal data will only be stored for a short term, or for one particular delivery (IP address, search for literature: data transfer/file transfer). For reasons of data security, for example to investigate unlawful access or prevent abuse of the website, the complete IP address of the requesting device is assessed, stored and anonymised seven days after access. Other data are stored for a longer period, until a request has been dealt with and the data are no longer needed, e.g. for further enquiries (searching for literature: reporting a broken link, reporting literature: reporting publications). Your e-mail address and possibly card file number are served for the purpose of communication with VG Wort -  permanently or for the duration of existence of peDOCS serviced, unless you report your disagreement to this measure.

7. Your rights

As a user of this internet service, you are entitled to the following rights pursuant to GDPR article 15-18, and article 20-21:

7.1 Right of access

Pursuant to article 15 GDPR or § 52 HDSIG (Hessisches Datenschutz- und Informationsfreiheitsgesetz), you can request information regarding your personal data we store. To assist us in compiling the necessary data, we kindly ask you to specify details concerning your application. Please bear in mind that your right of access is limited by regulations outlined in §§ 24 (2), 25 (2), 26 (2) and 33 HDSIG, § 52 (2) to 5 HDSIG.

7.2 Right to rectification

If the data concerning yourself are not (or no longer) applicable, you can demand their correction pursuant to 16 GDPR or § 53 HDSIG. If your data are incomplete, you can demand their completion.

7.3 Right of erasure

Subject to conditions outlined in article 17 GDPR and §§ 34 and 53 HDSIG, you can demand the erasure of your personal data.

7.4 Right to restriction of processing

Pursuant to the regulations outlined in article 18 GDPR or § 53 HDSIG, you have a right to demand the restriction of processing of your personal data.

7.5 Right to data portability

Pursuant to article 20 GDPR, you have a right to receive your personal data, which you have provided to us, in a structured, common and machine readable format. You are moreover entitled to transmit these data to another provider (controller), without being hindered by the controller who was first provided these data, in as far as

(1) Processing is based on consent pursuant to point a, article 6 (1) GDPR or point a, article 9 (2) GDPR or a contract pursuant to point b, article 6 (1) GDPR and

(2) Processing is carried out by automated means.

In exercising the above right, you are furthermore entitled to have your data directly transferred from one controller to another, if this is technically feasible. Freedoms and rights of others shall not be adversely affected.

7.6 Right to object

Pursuant to article 21 GDPR, for reasons given by your specific situation, you have a right to object to the processing of your personal data at any time , following from point e or f, article 6 (1 ).

7.7 Right to complain

If you think that we have not regarded a data protection regulation in processing your data, you can send a complaint to the supervisory data protection and freedom of information officer of the federal state of Hessen, who will handle your complaint, see article 77 GDPR, § 55 HDSIG.

8. Security advice

Please note that the transmission of data via internet (e.g. communication via e-mail) might be vulnerable to security flaws. It is impossible to assure that data will not be accessed by third parties. Hereby, we strictly object to the usage of contact data published in the compulsory imprint by third parties, for the purpose of transmitting unrequested advertisements and information materials. The providers of this website reserve their right to prosecute, in the case of receiving unrequested advertisement, for instance via spam mails.

9. Details concerning web analysis and social media platforms

Details concerning Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses so-called "Cookies", i.e. text files that are saved on your computer and that enable an analysis of your usage of the website. Generally, the information about your usage of a site that is generated via a cookie is transmitted to a Google server in the USA, and stored there. Owing to an activated IP anonymization, however, on this website, your IP address is abbreviated prior to transfer by Google within EU member states or states belonging to the European Economic Area. Only in exceptional cases, a complete IP address will be transferred to a Google server in the USA and abbreviated there for the purpose of anonymization. On behalf of the provider of this website, Google will use the information to analyse your usage of the site, to compile reports about the website activities, and to deliver further services linked to the usage of the website and internet usage to the operator of the website. The IP address delivered by your internet browser to Google Analytics will not be merged with any other data obtained by Google.

Details concerning Piwik/Matomo Web Analytics

Our website uses Piwik/Matomo, a so-called web analysis service. Piwik uses "cookies", i.e. text files that are stored on your computer and that enable us to analyse the usage of the website. The user information that is generated by the cookie (including your abbreviated IP address) is transmitted to our server and stored for the purpose of usage analysis. We use these data to optimise our website. Your IP address is immediately anonymised in the process, and you remain anonymous as a user. The information about your usage of our website obtained via the cookie is not transmitted to any third parties. References to publications that have gained a higher measure of attention in social media channels are enriched with a so-called Altmetrics Bagel. The display is based on an embeded graphical element that is transmitted by an external provider, Altmetric.com At the same time, several cookies are stored on your computer. Details concerning Google +1 Posting

For the assessment and transmission of information: The Google+1 button allows you to publish information worldwide. The Google+1 button delivers personalised content to you and other users from Google and Google partners. Google stores the information you have assigned +1 to a content as well as information concerning the page you visited while clicking onto +1. Your +1 can appear together with your profile name and photo in Google services, e.g. search results or your Google-profile or any other place on websites and advertisements on the internet.

Google records information about your +1 activities to improve Google services. In order to use the Google +1 button, you need a Google- profile that is visible worldwide and needs to contain at least the chosen Google profile name. This name is used in all Google services. In some cases, this name can replace another name you have used for sharing contents via your Google- account. The identity of your Google profile can be shown to other users who know your e-mail address or other information by which you can be identified.

Regarding usage of assessed information:

Besides the purposes illustrated above, the information you supply is used in accordance to applicable Google-data protection terms. Google might publish summarised statistics on +1-activities of users respectively release this information to users and partners, e.g. publishers, advertisers or associated websites.
