| Abstract (Englisch): | After World War II the Allies established school newspapers and school councils in West-German grammar schools as opportunities for participation. They sought to strengthen the sense of responsibility and community among the pupils. The Allies founded school newspapers and school councils to contribute to the democratization of post-war West Germany. In contrast to school councils, the legal status of these newspapers was unclear. They fell between the right to freedom of speech and the creation of a particular risk to the division of power. Restrictions of the fundamental right to freedom of opinion and expression contradict the ideal of democracy. In this article, I will set out a juristic discussion of this contradiction in the 1950s and 1960s and will explore approaches to solving this issue. The conclusion relates these findings to the contemporary legal state of school newspapers. (DIPF/Orig.) |
