| Abstract (German): | In seiner Entscheidung zu den pandemiebedingten Schulschließungen hat das Bundesverfassungsgericht im November 2021 erstmals ein im Grundgesetz garantiertes Recht auf schulische Bildung anerkannt. Der Beitrag beleuchtet die normative Herleitung und die einzelnen Gewährleistungsdimensionen des Grundrechts. Gefragt wird nach dessen innovativem Potenzial insbesondere im Hinblick auf den Abbau von Benachteiligungen im deutschen Schulsystem. Fragen, die das Bundesverfassungsgericht offengelassen hat, werden thematisiert und damit der Bedarf für die weitere Konkretisierung des Grundrechts aufgezeigt. (DIPF/Orig.) |
| Abstract (English): | In its decision on school closures due to the pandemic, the German Federal Constitutional Court in November 2021 recognized for the first time a right to school education guaranteed in the German constitution. The article examines the normative basis as well as the fundamental right’s different dimensions. The innovative potential of this right is examined, especially with regard to the reduction of disadvantages in the German school system. Questions left open by the Federal Constitutional Court are addressed and thus the need for further concretization of the fundamental right is pointed out. (DIPF/Orig.) |
