| Abstract (German): | Das Bundesverfassungsgericht hat in seinem Bundesnotbremse-II-Beschluss betont, dass sich aus Art. 2 Abs. 1 i. V. m. Art. 7 Abs. 1 GG ein Anspruch auf ein Mindestmaß schulischer Bildung ableiten lässt, ohne darzulegen, wie ein solcher jenseits der Pandemiezeiten konkretisiert werden kann. Dieser Beitrag geht der Idee nach, ob durch die Aufstellung kompetenzorientierter Bildungsstandards eine verwaltungsrechtliche Selbstbindung angenommen werden kann. Es werden Konstellationen vorgestellt, in denen diese in Ausnahmefällen in einen justiziablen Individualanspruch auf bildungsstandardkonformen Unterricht münden könnte. (DIPF/Orig.) |
| Abstract (English): | The Federal Constitutional Court has ruled in its decision on the constitutionality of Covid-19-school-closures that every child has a right to a minimum of school education, derived from Art. 2 (1) in connection with Art. 7 (1) Grundgesetz. This article strives to define this minimum beyond pandemic times by exploring the model of administrative commitment to educational standards. It demonstrates situations where this might, under exceptional circumstances, amount to a justiciable claim to school instruction in conformity with educational standards. (DIPF/Orig.) |
